Usage Agreement

Effective Date: October 20, 2024

This Usage Agreement ("Agreement") governs your use of the Site and Services provided by NMHIC ("we," "us," or "our"), including the Counselor Connect platform.

By accessing or using our Site and Services, you agree to be bound by this Agreement.

1. Use of the Site and Services

You may use the Site and Services only for lawful purposes and in accordance with this Agreement.

You agree not to:

• Use the Site or Services to transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Use the Site or Services to impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Interfere with or disrupt the Site or Services or servers or networks connected to the Site or Services.
• Violate any applicable local, state, national, or international law.

2. Counselor Connect

If you use the Counselor Connect platform, you agree to:

• Provide accurate and complete information when submitting appointment requests.
• Use the platform only to contact counselors for legitimate appointment inquiries.
• Respect the privacy of counselors and other users.
• Refrain from engaging in any harassing, abusive, or inappropriate behavior.

3. Intellectual Property

The Site and Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by NMHIC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

4. Disclaimer

The Site and Services are provided "as is" and without warranties of any kind, either express or implied.

We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

5. Limitation of Liability

In no event will NMHIC, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Site or Services.

6. Termination

We may terminate your access to all or any part of the Site or Services at any time, with or without cause, with or without notice, effective immediately.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

8. Changes to this Agreement

We may update this Agreement from time to time.

We will post any changes on this page and, if the changes are significant, we will provide a more prominent notice.
